Welcome to hardybanan.store (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

1. Nature of the Service

The Platform operates exclusively as an automated aggregator, passive index, and information portal. We do not manufacture, host, store, sell, or distribute any physical products or digital files. All product listings, links, and associated information displayed on the Platform are sourced from third-party marketplaces (including but not limited to Weidian and Taobao) and are not created, authored, owned, or verified by Hardybanan.

The Platform functions as a passive intermediary — comparable in nature to a search engine or community link aggregator — and does not exercise editorial control over the accuracy, legality, authenticity, or availability of any third-party listing. The presence of a listing on this Platform does not constitute an endorsement, recommendation, or guarantee of any kind.

We do not guarantee the accuracy, safety, or legality of any external links or third-party content. Transactions made on third-party sites are solely between the user and the external vendor. We accept no liability for financial losses, seized packages, customs fees, product quality disputes, or fraudulent third-party vendors.

2. Intermediary Liability — Section 230 & EU DSA

The Platform is operated as a community-driven information service and passive content aggregator. Accordingly, the Platform asserts protections available to intermediary platforms under applicable law, including:

• Section 230 of the Communications Decency Act (US): The Platform is not the publisher or speaker of any third-party content displayed or linked on the Platform, and shall not be treated as such.
• EU Digital Services Act (DSA) — Intermediary Liability Provisions: The Platform qualifies as a passive hosting and linking intermediary and does not have actual knowledge of, or control over, illegal activity by third-party vendors. Upon receiving valid notice of illegal content, the Platform will act expeditiously to remove or disable access.
• EU E-Commerce Directive (2000/31/EC): The Platform operates as a neutral conduit and information society service provider. We do not initiate transmissions, select recipients, or select or modify the information contained in third-party transmissions.

These protections apply specifically because the Platform does not create content, does not transact sales, does not take possession of goods, and acts solely as an organisational and linking layer over publicly accessible third-party marketplace data.

3. User-Generated Content (UGC)

Sections of the Platform, including but not limited to guide sections and community-sourced listings, may consist of or incorporate User-Generated Content.

• Users are solely responsible for the content they publish, share, or link to on the Platform.
• The Platform operates as a passive host under applicable safe harbor principles. We do not proactively monitor, review, or endorse user content before publication.
• By posting content on the Platform, the user guarantees that they have the legal right to do so and that the content does not violate any applicable laws or third-party rights.
• We reserve the right to remove any user-submitted content upon receiving a valid complaint or at our sole discretion, without prior notice.

4. Copyright & Trademark Policy (Notice and Takedown)

We respect the intellectual property rights of others. If you are a copyright or trademark owner (or an authorized agent) and believe that any content displayed or linked on our Platform infringes upon your rights, please submit a formal takedown request to: legal@hardybanan.store

Your request must include:

1. Proof of your identity and authorisation to act on behalf of the rights holder.
2. Exact URL(s) of the allegedly infringing material on our Platform.
3. A description of the copyrighted or trademarked work you claim has been infringed.
4. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorised to act on behalf of the rights holder.

Upon receiving a valid request, we will act expeditiously to remove or disable access to the relevant material. Note that the Platform links to third-party marketplaces and does not host product images or listings on its own servers in all cases. Where infringing content exists on a third-party platform, we will remove the link from our index and direct the rights holder to the relevant marketplace for further enforcement.

Repeat infringement: We will terminate access for users who are found to be repeat infringers in accordance with applicable law.

5. No Affiliation Disclaimer

Hardybanan is an independent platform and is not affiliated with, endorsed by, sponsored by, or acting as an agent of Kakobuy, Weidian, Taobao, 1688, or any brand, designer, or rights holder whose products may appear in third-party listings indexed on this Platform. Brand names and trademarks referenced in product listings belong to their respective owners and are used solely for identification and informational purposes.

6. Prohibited Conduct

While using the Platform, you agree not to:

• Use the Platform for any illegal purposes or to solicit others to perform or participate in unlawful acts.
• Upload or distribute viruses, malicious code, or use automated systems (bots, scrapers) to extract data from the Platform without permission.
• Post personal information (doxxing), spam, or content that degrades or harasses others.
• Misrepresent your identity or affiliation with any person or organisation.

We reserve the right to suspend or terminate access to the Platform for any user who violates these Terms, at any time and without prior notice.

7. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Platform. Any reliance you place on such information is strictly at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Hardybanan, its operators, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or any third-party content or services accessed through the Platform, including but not limited to loss of revenue, loss of profits, loss of data, or any other financial loss.

9. Jurisdiction and Dispute Resolution

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Moldova. Any disputes arising from or in connection with the use of the Platform shall be subject to the exclusive jurisdiction of the Moldovan courts. If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. The "Last Updated" date at the top of this page will reflect the most recent revision. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
